SUMMARY
Confidential Informants; Requiring a law enforcement agency that uses confidential informants to adopt policies and procedures providing reasonable protective measures; requiring law enforcement agencies that solicit persons to act as confidential informants to provide them with the opportunity to consult with an attorney before signing an assistance agreement; requiring a law enforcement agency to annually collect and submit confidential informant data to the Department of Law Enforcement, etc.

HB 267 - Confidential Informants

Confidential Informants: Requires law enforcement agency that uses confidential informants to adopt policies & procedures providing reasonable protective measures & requires agencies to refer certain prospective & current informants to substance abuse prevention or treatment; requires that policies & procedures provide general guidelines for management & safety of confidential informants & training requirements for certain agency personnel; revises factors used in assessing person's suitability as confidential informant; requires law enforcement agencies that solicit persons to act as confidential informants to provide them with opportunity to consult with attorney; prohibits minors from participating in certain activities; prohibits person who is receiving substance abuse services or related treatment from participating in certain activities; prohibits Florida College System & university police from recruiting or using enrolled students for certain activities; requires law enforcement agency to annually collect & submit confidential informant data.

Confidential Informants:

  • Creates "Rachel's Law";
  • requires law enforcement agency to disclose certain information to persons requested to be informants;
  • requires law enforcement agency to provide opportunity to consult with legal counsel to person requested to serve as informant;
  • requires training for persons involved with recruitment & use of informants;
  • requires agency to adopt policies & procedures to preserve safety of informants, law enforcement personnel, target offenders, & public;
  • requires agency that uses confidential informants to address recruitment, control, & use of informants in its policies & procedures;
  • requires agency to establish policies & procedures to assess suitability of potential informants;
  • requires agency to establish procedures to maintain security of records relating to informants;
  • requires agency to periodically review informant practices;
  • provides that act does not grant any right or entitlement to informant or person who is requested to be informant;
  • provides that any failure to abide by act does not create any additional right enforceable by defendant in criminal proceeding
